GENERAL INFORMATION, TERMS & CONDITIONS

MONDIAL TRAILS TOURS & TRAVELS (P) LIMITED in return for full payment by you of the amount specified, shall arrange for the transportation, accommodations, and other services specified and as included in this program as and to the extent you have selected them, and subject to the following terms and conditions:

BOOKINGS: All bookings are to be made with our head office in New Delhi as soon as possible to ensure confirmed accommodation, airline seats and train-tickets if any. This will be acknowledged by us and the latest position will be advised to you from time to time.

PAYMENTS: Full payment should be remitted in EUROS (€), USD, GBP or in other currencies towards the cost of the tour arrangements by following methods to our current account, no later than 15 days before arrival of the group.

Online Payments via Gateway

Transacting online with a credit card at Mondial Trails website is very safe and secure. We do not retain your credit card information. You can be assured that Mondial Trails offers the highest standards of security currently available on the internet so as to ensure that your transaction goes private, safe and secure. Visa, Master, American express and Diners Cards payments are processed through our online payment gateway systems. Your bank will authorize the card transaction directly without passing any information through us. In a short while, your bank will issue an authorization code and confirmation of completion of transaction.

PROCEDURES: When you have finalized your plans, please read the conditions and terms below as your booking is subject to these Conditions and Terms. A contract is formed once your deposit is received by MONDIAL TRAILS and we accept and confirm the booking. Please note that travel arrangements are not confirmed until stated in writing by MONDIAL TRAILS.

PAYMENT: A deposit of 25% of the tour price per person is required within seven (7) calendar days of issuance by us to you of an Advance invoice. The balance of the cost (75%) must be paid (and received by MONDIAL TRAILS office) 45 days prior to the first day of the tour. If the booking is cancelled by you in this manner, your 25% deposit shall be treated as a cancellation charge to cover MONDIAL TRAILS costs. If you book the tour within 45 days prior to the start of the tour, the full amount must be paid when the booking is confirmed.

CHANGES BY YOU: If you request any changes to your travel arrangements once we have confirmed a booking, all out of pocket expenses, including charges imposed by our suppliers, will be payable by you. Any name changes must be provided to us in writing and are subject to any airline fees or penalties. If after the commencement of the tour the Client requests any amendment to the agreed arrangements, or accommodation, the Company and/or their agents will do their best to implement such amendments, but cannot guarantee that it will be possible. In the event of an amendment, the Client will be liable for any cancellation charges and/or additional costs that may be incurred by the Company and/or their agents.

CANCELLATION BY YOU: You may cancel your booking at any time prior to commencement of the tour by notifying us in writing, which must be signed by the same person who booked the tour. Cancellation charges as below shall be applicable:

  • 57 Days before the first day of the tour – 25% retention charges of the deposit paid
  • 29-56 Days before the first day of the tour – 40% retention charges
  • 15-28 Days before the first day of the tour – 50% retention charges
  • Less than 14 Days before the first day of the tour or No Show – NO REFUND
  • No refund will be made after the tour has started

If your Reservation Form reflects any items as being Non-Refundable, the refunds will be modified from the aforesaid Schedule to reflect the entire Non-Refundable item. No allowance or refund can be given for meals, rooms, excursions or other parts of the tour that are not utilized by you when these are included in the price of the tour and no allowance or refund can be given due to lost, misplaced or destroyed travel tickets or vouchers. There are no exceptions of any kind (including medical exceptions) to these policies.

CANCELLATION BY MONDIAL TRAILS AND MAJOR CHANGES: The Company shall not cancel the tour after the date when payment of the balance of the price becomes due, unless it is necessary to do so as a result of Force Majeure, or unless the Client defaults in payment of such balance.

If the Company cancels the tour for any reason whatsoever prior to the date on which payment of the balance of the tour price becomes due, or for reasons for Force Majeure at any time prior to departure. The Company shall inform the Client without delay and offer the choice of an alternative holiday. If available, or full refund of all monies paid, excepting insurance premiums and amendment charges.

If the Client benefits from insurance in the event of the tour being cancelled by the company then the Company shall be liable to pay to the Client only the difference between the insurance payment and monies paid to the Company by the Client.

Notwithstanding the above, if the cancellation is made for reasons other than Force Majeure on or after the date when payment of the balance of the tour price is due. The Company shall offer reasonable compensation of € 75 per person.

ALTERATIONS TO THE TOUR by MONDIAL TRAILS: The Company will not materially alter the Client’s tour except for reasons of Force Majeure. If the Company has to make a material alteration to the tour, for any reason whatsoever, prior to the date on which payment of the balance of the price becomes due, or for reasons of Force Majeure, at any time prior to departure. The Company shall inform the Client without delay. The Company shall offer the Client the choice of either accepting the alteration or of cancelling the tour and receiving a full refund of all money paid. If the material alteration is made for reasons other than Force Majeure on or after the date on which the payment of the balance of the price becomes due. The Company shall offer compensation according to alteration proposed.

Hotels described by the Company as Deluxe or First Class are deemed so by the Company’s judgment and not necessarily by any official grading. The assessment is based on the Company’s knowledge of the establishment, general opinion and the standard of what is available locally. The terms used to describe the grading of hotel rooms i.e. deluxe, luxury suites etc are the same as those used by the hotels in question. The Company does not own, manage or control the accommodation that it uses and sometimes it is possible that the accommodation reserved is not available. In this event the Company and/or their agents will endeavor to provide accommodation of a higher or similar standard as available. The Company is NOT liable for any refund in this case.

PRICES: Prices are based on EUROS. Once your booking is accepted by us, we will not make any changes to your price after you have paid the final balance. Prior to the time you pay the final balance, we may revise the price of the tour solely due to increased transportation costs, including costs of fuel. No such revisions shall amount to more than 5% of the tour price. If you do not wish to accept the changes, you will be entitled to cancel the tour with a full refund of all amounts you have paid to us. OUR LIABILITY IN SUCH A CASE IS LIMITED TO A RETURN TO YOU OF ANY AMOUNTS YOU HAVE PAID TO US.

FORCE MAJEURE: Means any event which we “The company” or the suppliers of the service/s in question could not, even with all due care, foresee or avoid such as war or threat of war, civil unrest, riots, industrial dispute (e.g. airline strike), actual or threatened terrorist activities, natural or nuclear disaster or adverse weather conditions and all similar events beyond our control. As stated in these booking conditions the Company will promptly pay all monies in the event of canceling the Client’s holiday due to these conditions. However the Company will not cancel the Client’s holiday in these circumstances until specifically recommended to do so by the French Foreign Office.

THE CLIENT RESPONSIBILITIES: It is the Client’s responsibility to ensure that travel documents such as passports, visas and vaccinations certificates are in order. The Client must put in writing brief details of any facility not stated in the brochure or a quotation, which the Client feels the Company has said, will be available. The Company cannot accept claims after the event that something was agreed orally unless this was subsequently confirmed in writing.

AUTHORITY ON TOUR: While on tour the decisions of the Company’s representative or leader will at all times be final on matters concerning the safety and well being of the Client. The Client must at all times comply with the laws, customs, and foreign exchange and drug regulations of the countries visited. Should the Client fail to comply with the above the Company and its representatives reserve the right to order the Client to leave the tour without recourse to refund and without any legal claim against the Company.

DISCLAIMER: You, and each party traveling in your tour together with you, expressly acknowledge that you are aware of all risks of travel and arrangements for trips of this nature and fully disclaim, waive and discharge MONDIAL TRAILS (including its officers, members, directors and employees) from any and all liability, claims, damages, loss, or responsibilities (including damage to or loss of your property or your injury or death) with regard to the proposed tour and arrangements made with respect thereto, even if caused by the negligence of any airlines, transportation companies, hotels or any other party rendering any of the services or accommodations included in the tour. MONDIAL TRAILS shall similarly not be liable for any claims, losses, damages for delay of baggage or other properties, inconvenience, loss of enjoyment, upset and disappointment, distress or frustrations, whether physical or mental, resulting from any act or omission of any other party providing services to you. In the event of a service being withdrawn by any party who is to provide a tour service or accommodation, MONDIAL TRAILS shall have responsibility and our sole obligation shall be to make an appropriate refund to you commensurate with the nature of the service or accommodation which was withdrawn. All services and accommodations are subject to the laws, customs and regulations of the countries in which these services are rendered. You acknowledge that you and each member of your tour group are solely responsible for determining that you are in sufficient good health to undertake the tour. You also acknowledge that you are aware that conditions in India are not as advanced as in FRANCE and that you understand and assume the risks associated with travel in India. As an example, vehicles are not likely to be equipped with seat belts or other passenger restraints. You also acknowledge that parties who might require special assistance may have to make their own arrangements and should consider whether the tour is appropriate. As examples, India generally does not have special accommodations such as special accommodations for the blind or deaf. If your tour includes any bus transportation, you should be aware that there may be a minimum age (usually 7 years old) for such travel. It shall be your obligation to make us aware of any such situations.

PASSPORTS AND VISAS: All passengers and travelers are responsible for securing proper documentation prior to joining the tour. Valid Passports are required. All passport holders require separate visas for India and passengers and travelers are advised to check with respective consulates and/or visa agencies for full details.

INSURANCE: The Company will not carry the Client unless the Client has adequate personal travel insurance including medical and repatriation expenses. The Client accepts responsibility for arranging such insurance to satisfy the Client’s needs, either through the Company or from an outside agency. The insurance arranged must cover personal accident, medical expenses, air ambulance, loss of personal effects, repatriation and all other expenses that could arise as a result of loss, damage, injury, delay or inconvenience occurring to the Client.

When arranging travel insurance with any source other than the Company. The Client undertakes to provide the Company with written details of such insurance, and to sign an indemnity form that the Company will provide.

The Client accepts that the cost of the tour alone, as quoted by the Company, does not include the cost of any travel insurance.

The Client is strongly advised to arranged cancellation and curtailment insurance. The Client accepts that insurance regarding spouse and other dependants is an important matter for which the Client is responsible.

CLAIMS AND COMPLAINTS: If the Client has a complaint the Client must first inform the tour leader or company representative whilst on tour and the service provider immediately who will do their best to rectify the matter, Any further complaint must be made in writing to the Company during end of the tour i.e. before departure to home country. Please note that no complaint will be entertained unless it is made in writing.

DELAY OF DEPARTURE: In the event of the Client’s departure being delayed, after check-in for a flight. The Client’s welfare will be the responsibility of the airline involved. However, the Company its agents and representatives will give as much additional assistance as possible.

YOUR TOUR PRICE EXCLUDES:

  • Travel costs to arrive at the starting point of the tour
  • The cost of personal items such as laundry, drinks, incidentals, etc.
  • Airport security charges if levied by any airport to cover the cost of security arrangements
  • Airport taxes
  • Optional excursions, if any.
  • Costs of visas and passports
  • Gratuities for services provided on a personal basis
  • Meals, other than specified
  • Excess baggage charges

TERMS AND CONDITIONS: The payment of your deposit shall constitute consent to all provisions contained under this GENERAL INFORMATION, TERMS AND CONDITIONS.
